Project Description
Applicant proposes to construct and operate a state licensed residential care facility for the elderly (RCFE) containing 155 senior independent (“IL”) and assisted living (“AL”) units, and 28 secured memory care (“MC”) units at the Project Site (the “Modified Project”). All units within the Modified Project include a bathroom, closet and sleeping areas for the residents. The 155 IL and AL units will be outfitted with kitchenettes that include a refrigerator, a sink, and a microwave. 105 of the proposed IL/AL units also include a two-burner induction cooktop and hood. Thus, the 155 AL and IL units meet the definition of a “residential unit" under San Rafael Municipal Code (SRMC). The 28 memory care units are not provided with any kitchen facilities, and thus will not meet the definition of “dwelling unit” as it is defined in the San Rafael Municipal Code. However, under the California Civil Code they may be interpreted as a residential unit, and thus for the purpose of consistency with state law they are included the in the density bonus analysis for the Proposed Project. Also, as explained below, memory care units can be counted towards the City’s Sixth Cycle RHNA mandate.1 Therefore the Modified Project will provide a greater number of units that count toward the Sixth Cycle than the Prior Project (183 vs. 162). For all other purposes the proposed memory care units shall be classified according to the SRMC.

Planning Division received an Environmental and Design Review application for a proposed new seven story mixed use building at 1515 4th Street that would include 191 residential units and 4,000 square feet of commercial space.
June, 2022
Planning Division received a letter from the applicant intending to withdraw their Environmental and Design Review application and instead pursue a Senate Bill 35 (“SB 35”) process. SB 35 took effect on January 1, 2018, and it requires that development applications meeting certain criteria must be subject to a streamlined, ministerial approval process.
December, 2022
Planning Division received a letter from the applicant withdrawing their SB 35 letter of intent and instead continuing with a formal Environmental and Design Review application process. The applicant also provided revised plans that reduced the number of residential units to 162 units, while maintaining seven stories and 8,900 square feet of commercial space.
March 7, 2023
The Design Review Board recommended Planning Commission approval of the design aspects of the project.
April 11, 2023
The Planning Commission approved the Environmental and Design Review Permit for the project.
May 8, 2023
The Planning Commission approved the revised project.
July 23, 2024
The Planning Commission approved the revised project.
