The City of San Rafael has received many emails and phone calls concerning a local
police incident that was the subject of a recent story in the news media. Community members are angry about the conduct of San Rafael Police Department officers that
was captured on bodycam video.
Police Chief Dave Spiller has released an open letter to the community, copies of which
are available on demand in Spanish and English through the San Rafael Police
Department website. He said, “As the Police Chief, I take responsibility for all the
actions of our department. I am committed to addressing our shortcomings.”
Per the City Attorney’s direction, an independent investigator — unaffiliated with the
City — will conduct a thorough, unbiased review of the conduct of the officers and their
supervisors. At the conclusion of the investigation, after independent findings are
made, the Police Chief will decide what discipline, if any, to impose, up to and including
the potential of termination of employment.
Mayor Kate Colin said, “I am deeply saddened and distressed by this incident and look
forward to the findings of the independent investigator. I am listening to the
community’s anger and concerns and am putting aside my personal emotions to ensure
that the involved officers are given their legally mandated due process.”
The Mayor further commented, “We adopted the “8 Can’t Wait” use of force policies
after the murder of George Floyd and expect all officers to follow those policies. As part
of this investigation, we will review how those policies are being taught and
implemented. It is important to me that our community feels safe and trusts in their
police department and the City will take any and all steps necessary to make this
happen.”
